Terms of use

Introduction

These Terms of Use govern access to, download, installation, and use of the Sonequinha app ("App"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

About Sonequinha

Sonequinha is an app for logging, tracking, analyzing, and predicting babies' sleep, as well as providing soothing sounds and general information about infant sleep.

Changes to the Terms

We may update these Terms from time to time. When we do, the updated version will be made available in the App. Continuing to use the App after changes means you accept the new Terms.

Eligibility

The App is intended for parents or legal guardians. By using it, you state that you are at least 18 years old or have authorization from a legal guardian.

Usage requirements

You are responsible for:

  • Having a compatible device
  • Having internet access
  • Keeping the App up to date

Permitted use

You agree to use the App lawfully and appropriately and not to:

  • Use the App for illegal or fraudulent purposes
  • Interfere with the App's operation
  • Attempt to access systems, data, or code without authorization
  • Copy, extract, collect, or use App data for commercial or competitive purposes

License to use

We grant you a limited, personal, non-exclusive, and revocable license to use the App under these Terms.

You may not:

  • Copy, modify, or redistribute the App
  • Reverse engineer the App
  • Use the App for commercial purposes without authorization

User content

Data you enter, such as sleep logs and activities, remain yours. We may use these data in aggregated and fully anonymized form to improve the App's features, as detailed in our Privacy Policy.

Subscriptions and payments

Sonequinha offers free features and premium features through a subscription.

  • Subscriptions are processed and managed by the Apple App Store or Google Play Store, depending on the platform used.
  • Prices and billing periods are shown before purchase confirmation.
  • The subscription renews automatically at the end of each period unless canceled at least 24 hours in advance.
  • You can cancel at any time in your account settings in the app store.
  • Refunds are handled exclusively by Apple or Google under each platform's policies.
  • We do not charge you directly. All transactions take place through the app store.

Important health notice

Sonequinha does not replace medical advice. The information, predictions, and analyses provided are for information and education only and must not be used as a medical diagnosis or treatment.

If you have questions about your baby's health, consult a health professional.

Use of soothing sounds

The App provides soothing sounds to support your baby's sleep. When using them:

  • Keep the volume low and appropriate for your baby
  • Never place the device near your baby's ear
  • Prolonged use at high volume may harm hearing
  • The responsible adult is solely responsible for using this feature safely.

Sonequinha is not responsible for damage resulting from improper use of the sounds.

App availability

We do not guarantee that the App will be continuously available or error-free. We may perform maintenance, release updates, or temporarily interrupt features.

Account security

You are responsible for keeping your account confidential and for all activity on it. We reserve the right to suspend or close accounts in cases of misuse.

Distribution platforms and end-user license

These Terms are solely between you and Sonequinha. Apple Inc. and Google LLC are third parties to this contract and have no obligations regarding the App or these Terms.

Specifically regarding the Apple App Store:

  • Apple has no obligation to provide maintenance or technical support for the App
  • If the App fails to comply with an applicable warranty, you may notify Apple; Apple may refund the purchase price under its policies, and has no other warranty obligation
  • Apple is not responsible for claims by you or third parties related to the App or its use
  • If the App is alleged to infringe a third party's intellectual property rights, Apple is not responsible for investigating, defending, settling, or resolving the claim.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, by accepting them, Apple may enforce these provisions as a third-party beneficiary

The App is licensed, not sold. The license is personal, non-exclusive, non-transferable, and limited to use on devices authorized by the respective app stores.

Intellectual property

All content, design, branding, logos, and features of the App belong to Sonequinha or its licensors. No rights are granted beyond use under these Terms.

Limitation of liability

The App is provided "as is". To the maximum extent permitted by law, we are not liable for:

  • Indirect losses
  • Damage resulting from use or inability to use the App
  • Decisions made based on information provided by the App
  • Damage resulting from improper use of soothing sounds

Termination

We may suspend or terminate your access to the App if you breach these Terms. Termination revokes your license to use the App.

Applicable law

These Terms are governed by Brazilian law, including the Consumer Protection Code (Law No. 8,078/1990) and the General Data Protection Law (Law No. 13,709/2018). Any disputes will be resolved in the user's place of residence as permitted by applicable law.

Data protection

The processing of your personal data is governed by our Privacy Policy, available in the App, in accordance with the General Data Protection Law (LGPD, Law No. 13,709/2018) and, for users in the European Economic Area, the General Data Protection Regulation (GDPR, EU Regulation 2016/679).
